1. About Us

This website and online shop are operated by Tomasz Imiolczyk, trading as Tom Imio Photography, a sole trader registered in Ireland (Registered Business Name no. 787752, Companies Registration Office).

Registered address: 2 Meadowbrook Avenue, Maynooth, Co. Kildare, W23K0E4, Ireland. Contact: contact@tomimiophotography.com. References to “we”, “us” or “our” mean Tom Imio Photography; references to “you” mean the customer.

We are not registered for VAT. No VAT is charged on our sales, and prices shown are final prices (excluding any import charges described in Section 7).

2. Products

We sell original fine art photographic prints created, printed, signed and numbered by the artist. Each image is released in strictly limited editions with fixed edition sizes that will never be exceeded: Black Edition (1 unique print per image), Gold Edition (5 prints per format) and Silver Edition (10 prints per format). Every print is accompanied by a signed Certificate of Authenticity stating the title, year, medium, paper type and edition number.

Prints are produced on archival Hahnemühle fine art paper using pigment inks. Minor variations in colour and tone between the image displayed on your screen and the physical print are inherent to fine art printing and to differences in monitor calibration; such variations do not constitute a defect.

3. Ordering and Contract Formation

By placing an order you make an offer to purchase the selected product under these Terms. Order confirmation sent by email constitutes acceptance of your order and forms the contract of sale. We reserve the right to refuse or cancel an order in the event of pricing errors, unavailability of an edition number, or suspected fraud; in such cases any payment received will be refunded in full.

4. Prices and Payment

All prices are stated in euro (EUR). Payment is processed at checkout through the secure payment providers available on this website. We do not store your card details. Ownership of the goods passes to you on receipt of full payment; risk passes on delivery.

5. Shipping and Delivery

Prints are made to order and supplied flat in an archival presentation box, enclosed in rigid protective outer packaging, as described in our Shipping & Returns Policy. Orders are shipped from Ireland via tracked courier. Estimated production and delivery times are set out in our Shipping & Returns Policy, which forms part of these Terms. Delivery dates are estimates and not guaranteed; we are not liable for delays caused by carriers or customs authorities.

6. Risk of Loss and Damage in Transit

If your order arrives damaged, please contact us at contact@tomimiophotography.com within 48 hours of delivery with photographs of the damaged packaging and print. We will arrange a replacement (subject to edition availability) or a full refund. Damaged items may need to be returned to us; we will cover reasonable return costs for damaged or defective items. We ask you to contact us promptly so that we can deal with any claim with the carrier, but this does not affect your statutory rights.

7. Customs, Import Duties and Taxes (Orders Outside the EU)

All prints are shipped from Ireland. For orders delivered within the European Union, no customs duties or import charges apply.

For orders shipped outside the EU (including the United Kingdom, United States and other countries), your order may be subject to import VAT, customs duties or handling fees imposed by the destination country. These charges are determined by local customs authorities, are payable by you as the importer, and are not included in the purchase price or shipping cost. We have no control over these charges and cannot predict their exact amount.

All non-EU shipments are accompanied by a commercial invoice declaring the work as an original signed, numbered, limited edition photographic print, classified under CN code 4911 91 00 (printed photographs). Applicable rates depend on the rules of the destination country.

If a shipment is refused or returned because import charges were not paid, any refund will be issued minus the original shipping cost and any return or disposal fees incurred.

8. Right of Withdrawal (EU Consumers) and Returns

If you are a consumer in the EU, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 and the Consumer Rights Act 2022. To exercise this right, notify us within 14 days of delivery at contact@tomimiophotography.com and return the print within 14 days of that notice. Returned prints must be unused, undamaged, in their original archival presentation box and protective packaging, and accompanied by the Certificate of Authenticity. You are responsible for the cost and risk of the return shipment unless the item is defective. We recommend using tracked, insured shipping. Refunds are issued within 14 days of receiving the returned item (or proof of return), using the original payment method. The refund includes the standard delivery cost originally paid.

9. Intellectual Property and Copyright

Purchase of a print transfers ownership of the physical artwork only. Copyright and all other intellectual property rights in the photograph remain the exclusive property of Tomasz Imiolczyk. You may not reproduce, scan, photograph for reproduction, publish, communicate to the public, or commercially exploit the image in any form without prior written permission. All website content, including images and text, is protected by copyright.

10. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under Irish law, including consumer rights under the Consumer Rights Act 2022. Subject to that, our total liability arising from any order is limited to the amount paid for that order, and we are not liable for indirect or consequential loss.

11. Governing Law and Disputes

These Terms are governed by the laws of Ireland. If you are an EU consumer, you also benefit from mandatory protections of the law of your country of residence, and you may bring proceedings in Ireland or your home country. If you have a complaint, please contact us first at contact@tomimiophotography.com and we will do our best to resolve it. Irish consumers may also contact the Competition and Consumer Protection Commission (ccpc.ie); EU consumers may use the European Consumer Centres network (eccireland.ie).

12. Changes to These Terms

We may update these Terms from time to time. The version published on this website at the time of your order applies to that order.
